By initiative of the Ministry of Development and Investments, a State Aid Unit (MoKE) is operating since January 2002 at the Centre of International and European Economic Law (CIEEL), in Thessaloniki, Greece, aiming at supporting Greek Public Administration for the proper application of EU rules on State aid.
MoKE acts as legal expert consulting the Greek State aid network instituted by Law 4152/2013 (Central State Aid Unit and Decentralized State Aid Units), which examines the aids drafted by all granting authorities. In this context, MoKE provides legal advisory support and has also informative tasks. Its staff consists of jurists specialized in EU State Αid Law.
In particular, MoKE provides assistance to the Central State Aid Unit (KEMKE) and the Decentalised Units (AMKE) regarding the interpretation of the notion of State aid and on the numerous EU compatibility and proceduralrules (Guidelines, Regulations, Frameworks etc.), which are in a constant review by the Commission in order to be in line with market developments. For such an interpretation, MoKE draws from both the practiceof the Commission in similar State aid cases and the relevant case-law of the Court of Justice of the European Union (CJEU) and the General Court of the European Union.
